# Residence permit refused in Poland: how to appeal

By [Małgorzata](https://mypermit.pl/en/about.html) · Published 25 Oct 2026 · Updated 25 Oct 2026

If the voivode refuses your residence permit, you can appeal to the Head of the Office for Foreigners (UdSC) within 14 days of receiving the decision. The appeal is in writing and goes through the voivode who issued the decision, and it should be decided within 90 days. **Short answer.**Do not wait: the 14 days run from delivery of the decision. If you do not appeal and have no other basis to stay, you should leave within 30 days after the decision becomes final. **On this page**1. [Deadline](#deadline)

## Deadline

14 days from the day the decision was delivered to you. An appeal is your right, not an obligation.

## How to file

- In writing, addressed to the Head of UdSC, submitted through the voivode who issued the decision.
- By post, in person, or through another person at the voivode’s registry office, or electronically to the voivode’s e-delivery address.
- Not through MOS. The portal has a form that helps you prepare the appeal.

## After you appeal

The case is handled by UdSC (Department of Residence Legalisation). After you appeal, send further correspondence directly to UdSC. The appeal should be decided within 90 days. If it has formal defects, the 90 days count from when you fix them.

## If you do not appeal

If the permit is refused, you have no other basis to stay in Poland and you do not appeal in time, you should leave Poland within 30 days from the day the voivode’s decision became final. If you do not, a return decision may be issued.

## Where we can help

We can help you read the decision and draft the appeal, and represent you as proxy in the appeal proceedings. We are not a law firm, so complex legal disputes may need an attorney. **Not legal advice**This guide explains formalities. It is not legal advice from an attorney and does not replace the official instructions on gov.pl.
